Read this first — disclaimer
Daywhere is a tracking and support tool, not a tax or legal advisory service. Counts, projections and alerts are technical estimates based on the data your device provides. Daywhere's geolocation records do not by themselves constitute conclusive proof before the tax authority or any other administration or court: they are an indication you must back up with official documentation (tickets, invoices, certificates, entry and exit records). Before making decisions with tax consequences, consult a licensed professional.
1. What Daywhere is and isn't
Daywhere logs your trips and documents to help you keep count of the days you are present in each country (for example, Spain's 183-day rule). Tax residency depends on more factors than the day count (habitual home, center of economic interests, family ties) that Daywhere does not evaluate. Using Daywhere does not create an advisory relationship between you and Daywhere Labs S.L.
2. Accuracy of the data
Counting depends on your device's GPS, network and operating system, and can be affected by border areas, flights, tunnels, airplane mode, battery saving or revoked permissions. We give you tools to review and manually correct any day. You are responsible for reviewing the information before using it in filings or proceedings.
3. Your account and obligations
You must be at least 18, provide truthful information and safeguard your credentials. The account is personal and non-transferable. You may not use Daywhere for unlawful purposes, to falsify proof, or to evade tax obligations: any proof you upload must be authentic and something you have the right to use.
4. Plans, payments and cancellation
Daywhere is a paid service with a free trial period; once the trial ends, continued use requires an active subscription. Paid plans renew automatically at the end of each period unless cancelled beforehand from Settings. You can cancel anytime: you keep the plan until the end of the paid period. As a consumer you have 14 days to withdraw from purchase, unless you have already made effective use of the service. Plan changes are prorated on the next invoice.
5. Service availability
We provide the service with professional diligence, but we do not guarantee uninterrupted availability. We may perform scheduled maintenance, which we will announce when it affects counting. If you stop paying, automatic counting pauses but your data is not deleted and you can export it at any time.
6. Intellectual property
The software, trademarks and design of Daywhere belong to Daywhere Labs S.L. Your data and documents are yours: you grant us only the technical license strictly necessary to store, encrypt and display them to you.
7. Limitation of liability
To the maximum extent permitted by law, Daywhere Labs S.L. is not liable for penalties, tax assessments, surcharges or losses arising from decisions made based on information from the app, geolocation errors, or service unavailability. Nothing in these terms limits liability that cannot be legally limited (willful misconduct, personal injury). Otherwise, our total liability is limited to the fees you paid us in the 12 months prior to the event giving rise to it.
8. Changes to these terms
If we change something significant we will notify you at least 30 days in advance, in the app and by email. If you disagree, you can export your data and close your account before the changes take effect; continuing to use Daywhere means accepting them.
9. Governing law and contact
These terms are governed by Spanish law. Any dispute will be submitted to the courts of the user's domicile when acting as a consumer. Legal questions: legal@daywhere.app.
